It aims to replace the current, 24-year-old PIPEDA legislation (Personal Information Protection and Electronic Documents Act). If you\u2019re wondering what\u2019s new and how the changes will affect you,<\/span><span style=\"font-weight: 400;\">&nbsp;we\u2019ll tell you here. <\/span><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-5da5a15 e-flex e-con-boxed e-con e-parent\" data-id=\"5da5a15\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-529d775 elementor-widget elementor-widget-text-editor\" data-id=\"529d775\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p><b>Background:<\/b><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-8606d8e e-flex e-con-boxed e-con e-parent\" data-id=\"8606d8e\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-834d614 elementor-widget elementor-widget-text-editor\" data-id=\"834d614\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">The CPPA is Canada\u2019s attempt at next-generation privacy legislation. It is designed to replace PIPEDA.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">In addition to the Canada Privacy Act, Bill C-27 includes two other pieces of legislation:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Personal Information and Data Protection Tribunal Act (PIDPTA)<\/span>\u00a0<\/li><\/ul>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6e70af5 elementor-widget elementor-widget-text-editor\" data-id=\"6e70af5\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>The Tribunal Act (PIDPTA) provides an administrative tribunal for appealing decisions made under the Canada Privacy Act to the Privacy Commissioner of Canada (that sounds fun, eh!).\u00a0<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3d094e3 elementor-widget elementor-widget-text-editor\" data-id=\"3d094e3\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ul><li><span style=\"font-weight: 400;\">Artificial Intelligence and Data Act (AIDA)\u00a0\u00a0<\/span><\/li><\/ul>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9da95eb elementor-widget elementor-widget-text-editor\" data-id=\"9da95eb\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">The AI Act (AIDA) attempts to regulate how artificial intelligence systems may be used (wish them luck on this front!).\u00a0<\/span><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c7a72a4 elementor-widget elementor-widget-text-editor\" data-id=\"c7a72a4\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Our focus here is on the Canada Privacy Act. It\u2019s most impactful to Cleanlist\u2019s clients who collect and store personal information on Canadians.\u00a0<\/span><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-14084fd e-flex e-con-boxed e-con e-parent\" data-id=\"14084fd\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-4266a25 elementor-widget elementor-widget-text-editor\" data-id=\"4266a25\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<h5><b>How will Canada\u2019s Privacy Act affect my organization?<\/b><\/h5>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-45e5b78 e-flex e-con-boxed e-con e-parent\" data-id=\"45e5b78\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-2d070b5 elementor-widget elementor-widget-text-editor\" data-id=\"2d070b5\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p><b>1. You will need a privacy management program.<\/b><\/p><p><span style=\"font-weight: 400;\">Every organization will be required to have a \u201cprivacy management program\u201d that sets out specific policies and procedures to comply with the rules.<\/span><\/p><p><span style=\"font-weight: 400;\">In addition to policies and procedures, the plan must define what personal information is collected, and for what purpose. Only specific purposes are allowed, and those purposes will be set out in the rules.<\/span><b><\/b><\/p><p>\u00a0<\/p><p><b>2. Be prepared to answer tough consumer questions.<\/b><\/p><p><span style=\"font-weight: 400;\">A big focus of the new Act is to empower consumers to understand and control their personal information. You\u2019ll need to be prepared to answer consumer questions about what you collect, what you use it for, and how long you keep it.\u00a0<\/span><\/p><p>\u00a0<\/p><p><b>3. You\u2019ll need to ensure you have proper consumer consent.\u00a0<\/b><b><\/b><\/p><p><span style=\"font-weight: 400;\">The new Privacy Act has a heightened focus on obtaining, recording, and having proof of consent (when consent is required). It\u2019s not yet clear how consent requirements will be different from what\u2019s required today.\u00a0<\/span><\/p><p><br \/><b><\/b><\/p><p><b>4. Consumer\u2019s can request that their data is deleted.\u00a0\u00a0<\/b><b><\/b><\/p><p><span style=\"font-weight: 400;\">Your organization must honor consumer requests to have their personal information deleted (or anonymized). In case of an audit, you must be able to <\/span><i><span style=\"font-weight: 400;\">prove <\/span><\/i><span style=\"font-weight: 400;\">that deletion requests are tracked and executed in a timely manner.\u00a0<\/span><\/p><p><br \/><b><\/b><\/p><p><b>5. Consumer\u2019s can request \u201cdata transfers\u201d.\u00a0<\/b><b><\/b><\/p><p><span style=\"font-weight: 400;\">Your customers can request their data be transferred to a competitor, before you delete it. (This won\u2019t be easy to do, but then \u201ceasy\u201d wasn\u2019t part of the mandate.)<\/span><\/p><p><br \/><b><\/b><\/p><p><b>6. If you collect data on children, the rules are greatly expanded.\u00a0\u00a0<\/b><b><\/b><\/p><p><span style=\"font-weight: 400;\">The new Act will include especially-rigourous consent, use, and disclosure rules around data collected on minors (anyone under 18) as it will be considered \u2018sensitive\u2019 personal information. If this applies to you, you will need plenty of expert advice to comply.\u00a0<\/span><\/p><p><br \/><b><\/b><\/p><p><b>7. Huge penalties for violations.\u00a0\u00a0<\/b><b><\/b><\/p><p><span style=\"font-weight: 400;\">The Canadian government wants organizations to take their new rules seriously and they\u2019re doing that by imposing fines that are among the most spectacular across G7 countries.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">The proposed fines are of up to 5% of revenue or $25 million (whichever is <\/span><i><span style=\"font-weight: 400;\">greater<\/span><\/i><span style=\"font-weight: 400;\">), plus administrative monetary penalties of up to 3% of revenue or $10 million (whichever is <\/span><i><span style=\"font-weight: 400;\">greater<\/span><\/i><span style=\"font-weight: 400;\">). This will get plenty of attention in the boardroom!<\/span><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-cbafa9c e-flex e-con-boxed e-con e-parent\" data-id=\"cbafa9c\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-62ff03e elementor-widget elementor-widget-text-editor\" data-id=\"62ff03e\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<h5><b>When is Canada\u2019s Privacy Act effective?<\/b><\/h5>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-eaab00a e-flex e-con-boxed e-con e-parent\" data-id=\"eaab00a\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-27b3e82 elementor-widget elementor-widget-text-editor\" data-id=\"27b3e82\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">These new rules are still just proposals (not laws). No one knows when Bill C-27 will pass into law. We hear from several experts who are close to what\u2019s happening, and most think it will happen &#8212; sometime. Bill C-27 is being actively debated in the Canadian House of Commons, and there\u2019s a lot invested in the process. What we do know is that the wheels of the government move very slowly, so we likely have many months before this passes and then many more months before it becomes real.\u00a0<\/span><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-e7fdf93 e-flex e-con-boxed e-con e-parent\" data-id=\"e7fdf93\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-c920dae elementor-widget elementor-widget-text-editor\" data-id=\"c920dae\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<h5><b>Key Take-Aways:<\/b><\/h5>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-26bb58e e-flex e-con-boxed e-con e-parent\" data-id=\"26bb58e\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-2e37512 elementor-widget elementor-widget-text-editor\" data-id=\"2e37512\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">1. Canada already has very strict privacy laws, especially compared to the United States. And they\u2019re only going to get tougher.\u00a0\u00a0<\/span><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-49a62bb e-flex e-con-boxed e-con e-parent\" data-id=\"49a62bb\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-4551836 elementor-widget elementor-widget-text-editor\" data-id=\"4551836\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">2. Bill C-27 has been in the works for almost 3 years and still has a long way to go before becoming law.\u00a0<\/span><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-4d282c7 e-flex e-con-boxed e-con e-parent\" data-id=\"4d282c7\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-3dac308 elementor-widget elementor-widget-text-editor\" data-id=\"3dac308\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">3. Implementing Canada\u2019s new privacy act will be a huge project for many organizations. It will require an extensive review of how your organization collects, stores, and uses personal information on consumers. Expect to require expert advice and a lot of system and process modifications, many of which will require extensive I.T. resources.\u00a0<\/span><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-4507e05 e-flex e-con-boxed e-con e-parent\" data-id=\"4507e05\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-c99011b elementor-widget elementor-widget-text-editor\" data-id=\"c99011b\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">4.
